You may browse the site and share links or print reasonable portions of its content for personal use or your organization’s evaluation and use of MiPi services. Keep copyright and attribution notices intact.
Do not use the site for fraud, impersonation, threats, harassment, unauthorized access, malware distribution, or activity that disrupts its operation or infringes another person’s rights. Binding arbitration in Dallas County, Iowa
Subject to applicable law and the exceptions below, disputes arising out of these website terms or use of this website will be resolved by binding arbitration administered by the American Arbitration Association (“AAA”) under its applicable Commercial Arbitration Rules, or its Consumer Arbitration Rules when those rules apply.
The place of arbitration will be Dallas County, Iowa, unless applicable law or mandatory AAA requirements require a different location. Hearings may be conducted remotely or on written submissions when permitted by the applicable rules. Fees and costs will be allocated under the applicable AAA rules and law, including any required consumer protections. Current rules and fee information are available from AAA commercial dispute resolution and AAA consumer arbitration.
Binding arbitration generally replaces a court trial, including a jury trial, for covered disputes, and judicial review of an arbitration award is limited.
Either party may bring an eligible individual claim in small claims court or seek temporary court relief needed to protect rights while a dispute is resolved. Nothing here prevents reporting concerns to a government agency or exercising rights that cannot lawfully be made subject to arbitration. These terms do not waive a public entity’s statutory protections, immunities, or limits on its authority to agree to arbitration.
When court proceedings are appropriate
Subject to applicable law, proceedings concerning these website terms that may properly be brought in court will be brought in state courts located in Dallas County, Iowa, or, where federal subject-matter jurisdiction exists, the United States District Court for the Southern District of Iowa, Central Division, in Des Moines, Iowa. A court with appropriate jurisdiction may enforce an arbitration award. This clause does not create jurisdiction where none exists.
If the arbitration provision cannot lawfully be enforced for a particular dispute, that dispute may proceed in a court with jurisdiction. Applicable legal filing deadlines remain in effect; these terms do not impose a separate one-year claim deadline.
10. Changes and interpretation
We may revise these website terms and will show the revised date on this page. Revisions are intended to apply prospectively and do not by themselves change earlier transactions or previously accrued rights.
If a provision cannot lawfully be enforced, the remaining provisions continue to apply to the extent permitted by law. Failure to enforce a provision on one occasion does not by itself waive it on another. These terms do not create a partnership, employment, or agency relationship.
